الحمد لله
هذه المسألة قد تم بحثها في مجمع الفقه الإسلامي وأصدر بشأنها ما يلي :
أولاً : الطرق الخمس التالية محرمًا شرعًا ، وممنوعة منعًا باتًا لذاتها أو لما يترتب عليها من اختلاط الأنساب وضياع الأمومة وغير ذلك من المحاذير الشرعية .
الأولى : أن يجري التلقيح بين نطفة مأخوذة من زوج وبييضة مأخوذة من امرأة ليست زوجته ثم تزرع تلك اللقيحة في رحم زوجته .
الثانية : أن يجري التلقيح بين نطفة رجل غير الزوج وبييضة الزوجة ثم تزرع تلك اللقيحة في رحم الزوجة .
الثالثة : أن يجري تلقيح خارجي بين بذرتي زوجين ثم تزرع اللقيحة في رحم امرأة متطوعة بحملها .
الرابعة : أن يجري تلقيح خارجي بين بذرتي رجل أجنبي وبييضة امرأة أجنبية وتزرع اللقيحة في رحم الزوجة .
الخامسة : أن يجري تلقيح خارجي بين بذرتي زوجين ثم تزرع اللقيحة في رحم الزوجة الأخرى .
ثانيًا : الطريقان السادسة والسابعة لا حرج من اللجوء إليهما عند الحاجة مع التأكيد على ضرورة أخذ كل الاحتياطات اللازمة وهما :
السادسة : أن تؤخذ نطفة من زوج وبيضة من زوجته ويتم التلقيح خارجيًا ثم تزرع اللقيحة في رحم الزوجة .
السابعة : أن تؤخذ بذرة الزوج وتحقن في الموضع المناسب من مهبل زوجته أو رحمها تلقيحًا داخليًا . انتهى
ومن المحذورات التي تحصل في هذه القضية عمومًا : الكشف على العورة المغلّظة للمرأة ، وكذلك احتمالات حدوث الخطأ في المختبرات ، وأيضًا ما يمكن أن يقع من بعض ضعفاء النفوس في المستشفيات من مخالفة الأمانة بالاستبدال المتعمّد لإنجاح العملية لتحصيل الكسب المادي ، ولذلك كان لا بدّ من الحذر الشّديد في هذه المسألة والله تعالى أعلم .

Praise be to Allaah.
This matter has been studied by the Islamic Fiqh Council (Majma’ al-Fiqh al-Islami), who issued the following statement:
One: The following five methods are forbidden according to sharee’ah. They are forbidden either in and of themselves, or because of their consequences such as mixing lineages, not knowing who the child’s mother is, or other reasons that are objectionable according to sharee’ah.
When fertilization takes place between sperm taken from the husband and an egg taken from a woman who is not his wife, then the embryo is placed in his wife’s womb.
When fertilization takes place between sperm taken from a man who is not the husband, and an egg taken from the wife, then the embryo is placed in the womb of the wife.
When fertilization is done externally between the sperm and egg of the couple, then the embryo is placed in the womb of a woman who volunteers to carry it (“surrogate motherhood”).
When fertilization is done externally between the sperm of a man who is not the husband and the egg of a woman who is not the wife, then the embryo is placed in the womb of the wife.
When fertilization is done externally between the sperm and egg of the two spouses, then the embryo is placed in the womb of another wife (of the husband).
Two: The sixth and seventh methods are acceptable as a last resort in cases of necessity, when it is certain that all necessary precautions have been taken. These two methods are:
When the sperm is taken from the husband and an egg is taken from the wife, fertilization is done externally, then the embryo is planted in the womb of the wife.
When the sperm of the husband is taken and injected into a suitable place in the cervix or womb of the wife so that fertilization may take place internally.
Other reservations that pose a concern in this matter include: the uncovering of the woman’s ‘awrah and most private parts; the possibility of mistakes in the laboratory; the possibility that some weak-minded people in some hospitals may breach their trust and deliberately switch eggs or sperm in order to make the operation a success and earn more material gains. So we have to be extremely cautious when dealing with this matter. And Allaah knows best.

Louange à Allah Cette question a été largement examinée au sein de l’Académie Islamique de Jurisprudence et elle a émis à son propos la résolution que voici
Premièrement, les cinq méthodes suivantes sont absolument interdites par la religion pour elles-mêmes ou pour leurs conséquences qui se traduisent par le brouillage des généalogies et la perte de filiation maternelle et d’autres effets jugés religieusement pervers.
La première consiste à procéder à une fécondation in vitro réunissant un spermatozoïde prélevé sur un homme et un ovule prélevé sur une femme qui n’est pas son épouse, puis placer l’ovule fécondé dans l’utérus de l’épouse de l’homme en question.
La deuxième méthode consiste à procéder à une fécondation impliquant un spermatozoïde prélevé sur un donneur anonyme et un ovule fécondé dans l’utérus de l’épouse susmentionnée.
La troisième consiste à procéder à une fécondation in vitro impliquant des éléments prélevés sur un couple et implantés dans l’utérus d’une porteuse bénévole.
La quatrième consiste à procéder à une fécondation in vitro réunissant des éléments empruntés à un homme et une femme étrangers l’un à l’autre pour implanter l’ovule fécondé dans l’utérus d’une épouse.
La cinquième consiste à procéder à une fécondation in vitro impliquant des éléments prélevés sur deux époux, puis à les transplanter dans l’utérus d’une co-épouse.
Deuxièmement, les sixième et septième méthodes peuvent être utilisées au besoin, pourvu de prendre toutes les précautions qui s’imposent :
La sixième méthode consiste à procéder à une fécondation in vitro impliquant un spermatozoïde prélevé sur le mari et un ovule prélevé sur son épouse, puis à transplanter l’embryon dans l’utérus de l’épouse.
La septième méthode consiste à procéder au prélèvement d’un spermatozoïde sur le mari pour sa transplantation dans l’utérus de l’épouse afin que la fécondation s’y déroule.
Ces opérations comportent des effets pervers tels que le dévoilement de l’organe génital de la femme, l’éventualité d’erreurs dans les laboratoires. À cela s’ajoute ce qui pourrait provenir de certains personnels hospitaliers de faible moralité capables de violer la déontologie de leur profession en procédant à des substitutions délibérées pour assurer la réussite d’une opération et réaliser ainsi un gain matériel. C’est pourquoi cette question nécessite une grande vigilance. Allah le Très Haut le sait mieux.
