السؤال

أحرص دائمًا أن أتبع الحلال وأجتنب الحرام ، أعمل في محل تجاري يملكه يهودي منافق ، لديه العديد من المحلات وقد أغلقها فجأة ليطلب الأموال من الحكومة ، وفصل الناس من العمل دون أن يعطيهم رواتبهم وأبقى 5 أشخاص - أنا منهم - وفتح محلًا جديدًا ، لم يدفع الرواتب المتأخرة ، ودفع مبلغًا بسيطًا أقل بكثير من مستحقاتنا ، المحل الآن ناجح ولكنه لا يدفع لنا ، ودائمًا يقول لا يوجد لدي مال ، نواجه الآن مشكلة دون دفع رواتبنا ، وهذا هو الدخل الوحيد لنا ، قال أحد زملائي في العمل بأن نأخذ رواتبنا اليومية من دخل المحل وإذا دفع لنا في آخر الشهر نعيد له ماله في الخزنة وبدأ بفعل هذا ، ولكنني أخشى الحرام ، وأواجه الآن مشاكل مالية ، وقد سمعت بأنه سيفصلنا من العمل دون أن يدفع رواتبنا ، أرجو أن توضح لنا هذه المسألة وتنصحنا . مرة أخرى ، أنا أعمل بإخلاص وأمانة ولكنه يهودي منافق .

الحمد لله
هذه المسألة تسمَّى عند العلماء " مسألة الظَفَر " ، وفيها خلاف بين العلماء ، فمنهم من منع من أخذ الحق من الظالم ، ومنهم من أجازه بشرط أن لا يزيد على حقه وأن يأمن الفضيحة والعقوبة ، وهو الصواب من القولين .
قال الشنقيطي رحمه الله :
إنْ ظلمك إنسانٌ بأنْ أخذَ شيئًا مِن مالِك بغير الوجه الشرعي ، ولم يمكن لك إثباتُه ، وقدرتَ له على مثل ما ظلمك به على علو وجهٍ تأمن معه الفضيحة والعقوبة ، فهل لك أنْ تأخذَ قدرِ حقِّك أو لا ؟
أصحُّ القولين ، وأجراهما على ظواهر النصوص وعلى القياس : أنْ تأخذَ قدرَ حقِّك مِن غيرِ زيادةٍ ؛ لقوله تعالى في هذه الآية " فَعَاقِبُوا بِمِثْلِ مَا عُوقِبْتُم بِهِ…" الآية ، وقوله " فَاعْتَدُوا عَلَيْهِ بِمِثْلِ مَا اعْتَدَى عَلَيْكُم " ، وممن قال بِهذا القول : ابن سيرين ، وإبراهيم النخعي ، وسفيان ، ومجاهد ، وغيرهم .
وقالت طائفة من العلماء - منهم مالك - : لا يجوز ذلك ، وعليه دَرَج خليل بن إسحاق المالكي في " مختصره " بقوله في الوديعة : وليس له الأخذ منها لمن ظلمه بمثلها ، واحتج من قال بِهذا القول بحديث : " أَدِّ الأمَانَةَ إِلى مَنِ ائْتَمَنَكَ ، وَلا تَخُنْ مَنْ خَانَكَ " ا.هـ.
وهذا الحديث – على فرض صحته - لا ينهض الاستدلال به ؛ لأنَّ مَن أخذَ قدرَ حقِّه ولم يزد عليه لم يخن مَن خانه ، وإنما أنصف نفسه ممن ظلمه . " أضواء البيان " 3 / 353 .
وهو قول البخاري ، والشافعي ، كما نقله أبو زرعة العراقي في " طرح التثريب " 8 / 226 ، ونقل الترمذي أنه قول بعض التابعين ، وسمَّى منهم سفيان الثوري .
والحديث الذي استدل به المانعون هو حديث أبي هريرة قال : قال النبي صلى الله عليه وسلم : " أد الأمانة إلى من ائتمنك ولا تخن من خانك " رواه الترمذي : 1264 - وأبو داود : 3535 . وصححه الألباني في السلسلة الصحيحة 423.
فلك أن تأخذ حقَّك من هذا اليهودي صاحب العمل على أن لا تزيد على حقك ، وأن تأمن من أن يُكتشف أمرك خشية الفضيحة والإساءة للإسلام لأنك لا تستطيع إثبات حقك أمام الناس ، فإن أعطاك حقك بعدها أو شيئًا منه : فعليك أن تُرجع ما أخذته مما هو زائد على حقك .

Question

I am always follow halal and avoid haram.I work in a shop it belongs to a ju(yahooth)and he seems as a munafik.He had a lot of shops and he closed it suddenly to claim the money from the government and he sack the people without paying their wages.and he keep 5 people (including me) and open another branch.he didn't pay the wages for the previous month.after he paid some amount less than wages a month ago,but he didn't pay for the previous a big amount.and now shop taking is alright but he doesn't pay us and saying no money.now we face difficulies without our wages and this the only income to us.one my colleques is also a muslim he and another person said will take our wages every day from sales if he pay our wages properly and whole amount then we can put it back to the till and they follow it.But I am affraid to do it as whether it will be haram or not.I am finding difficulties and I heard he wants to send us also.then we will never get our wages.so please clear my dout and guide me according to islam.again I want to mention I work honestly,but he is realy munafik (israel).

Praise be to Allaah.
The scholars call this issue “the issue of settling scores”, concerning which there is a dispute among the scholars. Some of them say that it is not allowed to take what one is entitled to from a wrongdoer, and some say that it is allowed subject to the condition that he does not take more than he is entitled to and that there is no risk of being found out and punished. The latter is the correct view.
Shaykh al-Shanqeeti (may Allaah have mercy on him) said:
If someone wrongs you and takes something of yours in an unlawful manner, and you cannot prove it, but you are able to do something similar to the way in which he wronged you, with no risk of being found out or punished, do you have the right to take what you are entitled to or not?
The more correct of the two scholarly opinions, and the one which seems closest to the apparent meaning of the texts and is based on the more sound analogy, is that you may take that to which you are entitled, and no more, because Allaah says (interpretation of the meaning):
“then punish them with the like of that with which you were afflicted”
[al-Nahl 16:126]
“Then whoever transgresses the prohibition against you, you transgress likewise against him”
[al-Baqarah 2:194]
Among the scholars who were of this view are: Ibn Sireen, Ibraaheem al-Nakha’i, Sufyaan and others.
A number of scholars – including Maalik – said that this was not permitted. This is the view of Khaleel ibn Ishaaq al-Maaliki in his Mukhtasar, where he said concerning goods placed with a person for safekeeping: He does not have the right to take anything from them because that person wronged him. Those who held this view quoted as evidence the hadeeth: “Render back trusts to the one who entrusted it to you, and do not betray the one who betrays you.”
This hadeeth – even if we assume that it is saheeh – cannot be taken as evidence in this context, because the one who takes as much as he is entitled to, and no more, is not betraying the one who betrayed him, rather he is settling the score fairly with the one who wronged him.

This is also the view of al-Bukhaari and al-Shaafa’i, as narrated by Abu Zar’ah al-‘Iraaqi in Tarh al-Tathreeb, 8/226. Al-Tirmidh narrated that it was the view of some of the Taabi’een, among whom he mentioned Sufyaan al-Thawri.
The hadeeth quoted by those who do not allow it is the hadeeth of Abu Hurayrah who said: The Prophet (S) said: “Render back trusts to the one who entrusted it to you, and do not betray the one who betrays you.” Narrated by al-Tirmidhi, 1264; Abu Dawood, 3535; classed as saheeh by al-Albaani in al-Silsilah al-Saheehah, 423.
So you can take what you are entitled to from this Jew who owns the workplace, provided that you do not take more than what you are entitled to, and provided that there is no risk of being found out, which may damage the image of Islam, because you cannot prove your rights to people. If he gives you what you are entitled to after that, in whole or in part, then you have to return what you took from him that is surplus to what you are entitled to.

Je veille à n’utiliser que du licite et à éviter l’illicite. Je travaille dans un magasin qui appartient à un juif hypocrite qui possède de nombreux magasins. Le propriétaire a fermé subitement ses magasins pour réclamer des fonds au Gouvernement. Il a en plus renvoyé les travailleurs sans leur payer leurs salaires. Seuls cinq travailleurs dont moi-même ont été maintenus. Ensuite, au lieu de payer les arrières de salaires, il ouvre un nouveau magasin et nous remet une somme bien inférieure à ce qu’il nous doit. Le nouveau magasin marche bien mais le propriétaire refuse toujours de payer nos droits et affirme encore qu’il n’a pas d’argent. Nous sommes confrontés à un problème à cause du non paiement de nos salaires qui constituent notre seule moyen de subsistance.L’un de mes camarades m’a suggéré de prendre des affaires du magasin l’équivalent de de notre paie quotidien. S’il nous paye à la fin du mois, nous restituerons l’argent pris au coffre. Le camarade a commencé à appliquer ce qu’il a suggéré. Quant à moi, j’ai peur de l’illicite. Il est vrai que je suis embourbé dans des problèmes financiers et j’ai entendu qu’il va nous licencier sans nous payer nos salaires. J’espère que vous nous éclairerez sur cette question et nous donnerez un conseil. Je réitère encore une fois que je fais mon travail honnêtement et sincèrement mais j’ai affaire avec un juif hypocrite.

Les ulémas appellent cette question se faire justice soi-même Elle est l’objet d’une divergence de vues. Un groupe s’oppose au fait d’arracherson droitàun injuste tandis qu’un autre groupe le permet àcondition de ne pas dépasser son droit et d’agir de manière àéviterle déshonneur et le châtiment. Cet avisest le plus juste des deux avis émis sur la question.
Ach-chinquiti (Puisse Allah lui accorder Sa miséricorde) a dit: « Quand vous êtes lésépar quelqu’un qui s’empare d’une partie de vos biens illégalement sans que vous ayez la possibilitéde le prouver et que vous êtes en mesure de reprendre ce qu’il vous a prissans vous exposer au déshonneur et au châtiment, avez-vous ou non le droitde reprendre l’équivalent de votre droit?
Le plus juste des deux avis émis sur la question et plus conforme àl’apparence des textes et au raisonnement par analogie veut que vous repreniez votre droit sans aller au-delàen application de la parole du Très -haut: Infligezun châtiment proportionnel àcelui que vous avez subi… etRépliquez proportionnellementàcelui qui vousagresse. Cet avis est adoptépar Ibn Sirine, par Ibrahim an-Nakhaee, par Soufiane, par Moudjahid et par d’autres. Un autre groupe d’ulémas dont Malick s’y oppose. Le malikite, Khalil ibn Isaac , reprenant cet avis , dit dans son précis de droit àpropos du dépôt: Il n’est pas permis au dépositaire de saisirune partie du bien déposépour réparer un tort commis àson détriment par le déposant. Les partisans de cet avis trouvent un argument dans ce hadith: Restituez les dépôtsplacés auprès de vous par des gens qui vous font confiance. Netrahissez pas ceux qui vous trahissent.
A supposer que ce hadith soitauthentique, il ne saurait pas servir d’argument car celui quis’empare de l’équivalent deson droit sans rien de plus n’a pas commis une trahison puisque qu’il n’a fait que se faire justice. »Voir Adhwaa al-Bayan (3/353)
C’est l’avis d’al-Bokhari et de Chaafii selon ce qu’Abou Zour’aaal-iraqui a rapportédans Tarh at-tathriib, (8/226) At-Tirmidhi a rapportéque c’est encore l’avis d’une partie des successeurs immédiats des compagnons dont Soufyane ath-Thawri.
Le hadith utilisécomme argumentpar les opposants est celui rapportépar Abou Hourayrah selon lequel le Prophète (Bénédiction et salut soient sur lui) a dit: Restituez les dépôtsplacés auprès de vous par des gens qui vous font confiance. Netrahissez pas ceux qui vous trahissent. (Rapportépar at-Tirmidhi (1264) et par Abou Dawoud (3535) et jugéauthentique par al-Abani dansas-silsilah as-sahiha (423).
Vous avez le droit de reprendre votre dûauprès de cepatron juifàcondition de ne pas aller au-delàetd’être àl’abri du déshonneuret d’un mauvais traitement de l’islam en cas de découverte de votre acte. C’est parce que vous n’êtes pas en mesure de prouvervotre droit devant les gens.S’il vous donnait plus tard votre droit entièrement ou partiellement, vous devriez lui restituer ce que vous auriez pris en plus de votre droit.
