السؤال

في يوم من أيام قضاء رمضان نويت الصيام مع بداية أذان الفجر وأكملت الصيام ، فهل يصح صيامي ؟
نص الجواب


الحمد لله
أولا :
تبييت النية من الليل شرط لكل صوم واجب على الراجح من قولي أهل العلم ، قضاءً كان ذلك الصيام أو أداءً ؛ وهذا قول جمهور أهل العلم .
قال ابن قدامة "إن كان فرضًا كصيام رمضان في أدائه أو قضائه ، والنذر والكفارة ، اشترط أن ينويه من الليل عند إمامنا ومالك ، والشافعي ، وقال أبو حنيفة: يجزئ صيام رمضان وكل صوم متعين ، بنية من النهار " انتهى من " المغني " 3/109 .
ودليل وجوب تبييت النية : ما ثبت عن النبي صلى الله عليه وسلم " من لم يجمع الصيام قبل الفجر فلا صيام له " رواه الترمذي :730، وصححه الألباني في "صحيح الترمذي" وقال الترمذي عقبه : " وإنما معنى هذا عند أهل العلم لا صيام لمن لم يجمع الصيام قبل طلوع الفجر في رمضان ، أو في قضاء رمضان ، أو في صيام نذر ؛ إذا لم ينوه من الليل لم يجزه ، وأما صيام التطوع فمباح له أن ينويه بعد ما أصبح ، وهو قول الشافعي وأحمد وإسحق " انتهى .
ثانيًا :
يلزم مريد الصوم الواجب ، عقد نيته قبل طلوع الفجر الصادق ، كما قال تعالى "وَكُلُوا وَاشْرَبُوا حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الأَبْيَضُ مِنَ الْخَيْطِ الأَسْوَدِ مِنَ الْفَجْرِ "البقرة/187 .
فالعبرة بطلوع الفجر ، لا بالأذان ، فمن تيقن طلوع الفجر الصادق ولم يكن نوى الصيام ، فإن صيامه للفريضة أداء كان أو قضاء ، لا يصح .
وأما من لم يتيقن طلوع الفجر ، فله أن يؤخر النية إلى آخر لحظة قبل طلوعه ، وكذا لو علم أن المؤذن يؤذن قبل الوقت ، أو شك أنه يؤذن في الوقت أو قبله .

ثالثًا :
غالب المؤذنين اليوم يعتمدون على الساعات والتقاويم ، لا على رؤية الفجر ، وهذا لا يعتبر يقينا في طلوع الفجر ، فمن أكل أو عقد نيته حينئذ ، فصومه صحيح ، لاسيما إن كان إمساكه في بداية الأذان ، كما في الحال المسؤول عنها ؛ لأنه لم يتيقن طلوع الفجر .
وقد سئل الشيخ عبد العزيز بن باز رحمه الله : ما الحكم الشرعي في صيام من سمع أذان الفجر واستمر في الأكل والشرب ؟
فأجاب " الواجب على المؤمن أن يمسك عن المفطرات من الأكل والشرب وغيرهما إذا تبين له طلوع الفجر ، وكان الصوم فريضة كرمضان وكصوم النذر والكفارات ؛ لقول الله عز وجل " وَكُلُوا وَاشْرَبُوا حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الأَبْيَضُ مِنَ الْخَيْطِ الأَسْوَدِ مِنَ الْفَجْرِ ثُمَّ أَتِمُّوا الصِّيَامَ إِلَى اللَّيْلِ " البقرة/187 .
فإذا سمع الأذان ، وعلم أنه يؤذن على الفجر : وجب عليه الإمساك .
فإن كان المؤذن يؤذن قبل طلوع الفجر ، لم يجب عليه الإمساك ، وجاز له الأكل والشرب حتى يتبين له الفجر .
فإن كان لا يعلم حال المؤذن : هل أذن قبل الفجر أو بعد الفجر ، فإن الأولى والأحوط له أن يمسك إذا سمع الأذان ، ولا يضره لو شرب أو أكل شيئا حين الأذان لأنه لم يعلم بطلوع الفجر .
ومعلوم أن من كان داخل المدن التي فيها الأنوار الكهربائية ، لا يستطيع أن يعلم طلوع الفجر بعينه وقت طلوع الفجر ، ولكن عليه أن يحتاط بالعمل بالأذان والتقويمات التي تحدد طلوع الفجر بالساعة والدقيقة ، عملا بقول النبي صلى الله عليه وسلم " دَعْ مَا يَرِيبُكَ إِلَى مَا لا يَرِيبُكَ " وقوله صلى الله عليه وسلم " مَنْ اتَّقَى الشُّبُهَاتِ اسْتَبْرَأَ لِدِينِهِ وَعِرْضِهِ" والله ولي التوفيق " .

وسئل الشيخ ابن عثيمين رحمه الله : متى يمتنع الإنسان عن الأكل ؟ هل هو كما يقولون: عندما يهلل المؤذن؟ وما الحكم إذا شرب بعد الأذان متعمداً ؛ هل هو كمن شرب بعد العصر أم له صيام ؟ فحجة بعض الناس يقول : بأن الفجر ليس كالمصباح يضيء بسرعة ، والأمر واسع فما الحكم؟
فأجاب" إذا كان المؤذن يؤذن إذا تبين الفجر ، فقد قال النبي صلى الله عليه وآله وسلم "كلوا واشربوا حتى يؤذن ابن أم مكتوم ، فإنه لا يؤذن حتى يطلع الفجر". فإذا قال المؤذن : أنا رأيت الفجر ، وأنا لا أؤذن حتى أرى الفجر ؛ فإنه يجب على الإنسان أن يمسك من حين أن يسمع الأذان ، إلا في الحالة التي رُخص له فيها ، وهو ما إذا كان إناؤه في يده فله أن يقضي نهمته منه .
وأما إذا كان الأذان حسب التوقيت ، فالتوقيت ليس في الحقيقة مربوطاً بالأوقات الحسية الظاهرة ، ولكنه توقيت بالحساب -المواقيت التي بأيدينا الآن توقيت أم القرى وغيره هو بالحساب - لأنهم لم يشاهدوا الفجر ، ولا الشمس ، ولا الزوال ، ولا دخول العصر ، ولا غروب الشمس " انتهى من "اللقاء الشهري" 1/214 .

وبناء على هذا ؛ فصومك صحيح إن شاء الله تعالى ، لأننا لا نتيقن أن المؤذن يؤذن مع أول طلوع الفجر

Question

On one of the days when I wanted to make up a Ramadan fast, I formed the intention to fast as the adhaan for Fajr began, and I completed the fast. Is my fast valid?
Answer







Praise be to Allah.
Firstly:
Having the intention from the night before is a condition for every obligatory fast, according to the more correct scholarly opinion, whether that is making up that missed fast or observing it on time. This is the view of the majority of scholars.
Ibn Qudaamah said: If it is an obligatory fast, such as a Ramadan fast being observed on time or being made up later, or a fast in fulfilment of a vow, or a fast offered in expiation, it is stipulated that the person should form the intention from the night before, according to our imam, and Maalik and ash-Shaafa‘i. Abu Haneefah said: It is acceptable for a Ramadan fast and any fast for a specific reason to form the intention from that day.
End quote from al-Mughni (3/109)
The evidence for it being obligatory to form the intention from the night before is the report which was proven to be from the Prophet (blessings and peace of Allah be upon him), according to which he said: “Whoever does not decide to fast before dawn, his fast does not count.” Narrated by at-Tirmidhi (730) and classed as saheeh by al-Albaani in Saheeh at-Tirmidhi. At-Tirmidhi said, after quoting this hadith: What this means, according to the scholars, is that there is no fast for the one who does not decide to fast before dawn breaks, whether in Ramadan or when making up missed Ramadan fasts or when fasting in fulfilment of a vow. If he does not form the intention from the night before, then it does not count. As for voluntary fasts, it is permissible for him to form the intention after he gets up (in the morning). This is the view of ash-Shaafa‘i, Ahmad and Is-haaq. End quote.
Secondly:
The one who wants to observe an obligatory fast must form his intention before the true dawn breaks, as Allah, may He be exalted, says (interpretation of the meaning):
“and eat and drink until the white thread (light) of dawn appears to you distinct from the black thread (darkness of night)”
[al-Baqarah 2:187].
So what counts is the break of dawn, not the adhaan. If a person is certain that the true dawn has broken, and he did not form the intention to fast, then his observance of an obligatory fast, whether he was doing it on time or was making it up, is not valid.
But if he is not certain that dawn has broken, then he may delay forming the intention until the last moment before dawn does break. The same applies if he knows that the mu’adhdhin gives the adhaan ahead of time, or he is not sure whether he gives the adhaan on time or ahead of time.

Thirdly:
Most mu’adhdhins nowadays rely on clocks and timetables, not on actually sighting the dawn, and this cannot be regarded as certainty that dawn has broken. So whoever eats or forms his intention at that time, his fast is valid, especially if he stops eating when the adhaan begins, as in the case asked about here, because he was not certain that dawn has broken.
Shaykh ‘Abd al-‘Azeez ibn Baaz (may Allah have mercy on him) was asked: What is the Islamic ruling on the fast of someone who hears the adhaan of Fajr but carries on eating and drinking?
He replied: What is required of the believer is to refrain from things that break the fast – eating, drinking and so on – when it becomes clear to him that dawn has broken, if the fast is obligatory, such as in Ramadan, fasts observed in fulfilment of vows, and expiatory fasts, because Allah, may He be glorified and exalted, says (interpretation of the meaning):
“and eat and drink until the white thread (light) of dawn appears to you distinct from the black thread (darkness of night)”
[al-Baqarah 2:187].
If he hears the adhaan and knows that the adhaan is usuall given at the time of dawn, then he must stop eating and drinking.
If the mu’adhdhin gives the ahdaan before dawn breaks, then he does not have to stop eating and drinking; it is permissible for him to eat and drink until it becomes clear to him that dawn has broken.
If he does not know whether the mu’adhdhin gives the adhaan before or after dawn breaks, then to be on the safe side it is better for him to stop eating and drinking when he hears the adhaan, and it will not matter if he eats or drinks something at the time of the adhaan, because he does not know whether dawn has broken. It is well-known that those who live in cities where there are electric lights cannot know whether dawn has broken from looking, but to be on the safe side they should follow the adhaan and timetables which state the time of dawn in hours and minutes, acting in accordance with the words of the Prophet (blessings and peace of Allah be upon him): “Leave that which makes you doubt for that which does not make you doubt” and “Whoever guards against the doubtful matters will protect his religious commitment from shortcomings and will protect his honour from slander.” And Allah is the source of strength.

Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) was asked: When is it forbidden for a person to eat? Is it as they say: when the mu’adhdhin says Laa ilaaha ill-Allah? What is the ruling if he drinks deliberately after the adhaan? Is he like one who drinks after ‘Asr, or does his fast count? Some people justify that by saying that dawn is not like a lamp that begins to shine quickly, and the matter is broad in scope. What is the ruling?
He replied: If the mu’adhdhin gives the adhaan when dawn becomes clear, then the Prophet (blessings and peace of Allah be upon him) said: “Eat and drink until Ibn Umm Maktoom gives the adhaan, for he does not give the adhaan until dawn breaks.” If the mu’adhdhin says: I have seen the dawn and I do not give the adhaan until I see the dawn, then the individual must stop eating and drinking when he hears the adhaan, except in the case concerning which a concession has been made, which is a person has his vessel in his hand, in which case he may drink what he needs from it.
But if the adhaan is given according to a timetable, then the timetable is not actually connected to the actual visible time – as it is based on calculations. The timetables we have nowadays, such as the Umm al-Qura timetable and others, are based on calculations, because they do not actually observe the dawn, or the sun, or the zenith, or the beginning of ‘Asr, or the setting of the sun.

Based on the above, your fast is valid, in sha Allah, because we cannot be certain that the mu’adhdhin was giving the adhaan at the time when dawn began.

Une fois j'ai voulu jeûner un jour pour rattraper le jeûne du Ramadan et j'en ai nourri l'intention au commencement de l'appel à la prière du matin..Mon jeûne est il valide?

Louanges à Allah
Premièrement, avoir l'intention de jeûner depuis la veille est une condition de validité de tout jeûne obligatoire selonle mieux argumentédes deux avis émis par les ulémas; qu'il s'agisse d'un jeûne effectué à titre de rattrapage ou d'un jeûne immédiat. Voilà l'avis de la majorité des ulémas.
Ibn Qoudama dit :«Si on s'engage dans un jeûne obligatoire comme celui observé au cours du Ramadan et celui accompli pour le rattraper ou encore le jeûne répondant à un vœu ou ayant une fonction expiatoire, (dans ces différents cas)on est régis par la condition d'en avoir nourri l'intention depuis la veille selon les avis de notre imam (Ahmad) , de l'imam Malick et de Chaffie. Quant à Abou Hanifa, il dit: Tout jeûne qui s'avère obligatoire, qu'il s'agisse de celui du Ramadan ou d'un autre, peut valablement être observé sur la base d'une intention nourrie dans la journée. Extrait d'al-Moughni (3/109).
L'argument qui permet de soutenir que l'intention de jeûner doit exister depuis la veille réside dans ce hadith du Prophète (Bénédiction et salut soient sur lui):Celui ne se décide pas à jeûner avant l'entrée de l'aube, n'aura pas jeûné valablement. Rapporté ar at-Tirmidhi (730) et déclaré authentique par al-Albani dans Sahih at-Tirmidhi). Ce dernier en dit: Ce hadith signifie, selon les ulémas, que le jeûne observé par celui qui ne se serait pas décidé à le faire avant l'entrée de l'aube n'est pas valide. Que le jeûne soit accompli pour rattraper celui du Ramadan ou pour exécuter un vœu. Si le fidèle n'en a pas eu l'intention depuis la veille, le jeûne n'est pas valide. Quant au jeûne surérogatoire, on peut en nourrir l'intention, même au matin. C'est l'avis de Chaffie, d'Ahmad et d'Isaac.
Deuxièmement, celui veut s'engager dans un jeûne obligatoire doit en nourrir l'intention avant l'entrée de l'aube, conformément à la parole du Très-haut: Mangez et buvez jusqu'à ce que se distingue, pour vous, le fil blanc de l'aube du fil noir de la nuit. (Coran,2:187). Ce qui compte c'est l'entrée de l'aube authentique non l'appel à la prière. Si on constate l'entrée de l'aube sans avoir nourri l'intention de jeûner, le jeûne qu'on accomplit par la suite n'est pas valide.
Quant à celui qui n'est pas certain de l'entrée de l'aube, on lui permet de retarder la formulation de son intention jusqu'au dernier moment avant l'entrée de l'aube. Il en serait de même quand on sait que le muezzin lance son appel à la prière bien avant l'heure prévue pour l'accomplissement de celle-ci. C'est aussi le cas si on doute que le muezzin lance son appel à temps ou avant l'heure. Voir la réponse donnée à la question n° 66202.
Troisièmement, la plupart des muezzins de nos jours comptent sur leurs montres et se conforment au calendrier et non sur le constat visuel de l'aube. Ce qui ne donne pas une certitude à propos de l'entrée de l'aube. Celui qui mange ou nourrit l'intention de jeûner en ce laps de temps aura jeûné valablement. C'est surtout le cas quand on a cessé de manger avant le commencement de l'appel à la prière, comme c'est le cas objet de la présente question, car l'intéressée n'est pas sûre de l'entrée de l'aube.
Cheikh Abdoul Aziz ibn Baz (Puisse Allah lui accorder Sa miséricorde)fut interrogé en ces termes: Quel est le jugement de la loi religieuse sur le cas de celui qui, tout en ayant entendu l'appel à la prière, continue de manger et de boire?
Voici sa réponse: «Le croyant doit cesser tout acte de nature à rompre le jeûne, notamment le manger et le boire entre autres, dès qu'il constate l'entrée de l'aube, s'il s'agit d'observer un jeûne obligatoire comme celui du Ramadan, celui fait pour exécuter un vœu ou à titre expiatoire, conformément à la parole d'Allah le Puissant et Majestueux: Mangez et buvez jusqu'à ce que se distingue, pour vous, le fil blanc de l'aube du fil noir de la nuit Puis accomplissez le jeûne jusqu'à la nuit.(Coran,2:187). Quand on entend l'appel à la prière et sait qu'il s'agit de l'appel à la prière du matin, on doit se mettre à jeûner. Si le muezzin lance son appel avant l'entrée de l'aube, on n'est pas tenu de se mettre à jeûner (immédiatement). Aussi peut on continuer à manger et à boire jusqu'à ce que l'aube se dégage.
S'il ne connait pas l'état du muezzin et ne sait pas s'il a lancé son appel avant ou après l'aube, il vaut mieux, par précaution, qu'il se mette à jeuner dès qu'il entend l'appel à la prière. Il n'encourrait rien s'il mangeait ou boirait au moment du déroulement de l'appel car il ne sait pas si l'aube est réellement entrée.
Il est bien connu que celui qui se trouve dans une ville bien éclairée ne peut constater l'entrée de l'aube de lui-même dès que cela arrive. Il doit toutefois prendre ses précautions pour ne lancer l'appel à la prière que conformément au calendrier qui fixe l'heurede l'entrée de l'aube à la minute en application de cette parole du Prophète (Bénédiction et salut soient sur lui): Laisse ce qui t'intrigue pour te contenter de ce qui ne t'inspire aucun soupçon. et sa parole :Celui évite les choses suspectes sauve sa religion et son honneur. Allah est le garant de l'assistance. Extrait des fatwas du Ramadan collectées par Ashraf Abdoul Maqsoud,p.201.
Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa miséricorde) fut interrogé en ces termes: A quel moment doit on cesser de manger? Est-ce , comme on le dit, au moment du lancement de l'appel? Comment juger celui qui boit sciemment après ce moment? Est-il assimilable à celui qui boit après la seconde prière de l'après midi ou son jeûne reste valide? Certains arguent que l'aube n'est pas comme une lampe qui éclaire vite et que l'affaire est l'objet d'une grande latitude. Comment juger tout cela?»
Voici sa réponse:« Si le muezzin lance son appel quand l'aube se dégage nettement, le Prophète (Bénédiction et salut soient sur lui) a dit: Mangez et buvez jusqu'à ce qu'Ibn Oumi Maktoum lance son appel à la prière car, lui, il ne le fait qu'à l'entrée de l'aube. Si le muezzin dit: «Moi, j'ai constaté l'entrée de l'aube et je ne lance mon appel à la prière qu'en ce moment, l'on doit se mettre à jeûner dès qu'on entend son appel à la prière, en dehors du cas objet d'une dispense, à savoir celui/celle dont la main est dans le bol car il/elle peut se rassasier.
Si l'appel à la prière se fait selon les heures fournies par les calendriers, ces heures ne reflètent pas celles fondées sur le constat visuel. Ce n'est fondé que sur le calcul. Le calendrierque nous possédons, comme Oumou Qoura et d'autres, reposent sur le calcul car ces auteurs ne constatent pas visuellement l'entrée de l'aube ni ne voient le soleil ni ne constatent l'inclinaison ni l'entrée de la seconde prière de l'après midi ni le coucher du soleil.» Extrait de liqaa ach-chahri (1/214). Cela étant, votre jeûne est valide, s'il plaît à Allah Très-haut, car nous ne sommes pas sûrs que le muezzin lance son appel à la prière dès l'entrée à l'aube.
