السؤال

عندي قريبة توفاها الله هي وزوجها معا في حادث ولم يمض على زواجهما إلا خمس شهور تقريباً وكان هذا الزواج الأول لها ، أما هو كان لديه زوجة أولى وأولاد وبنات وعندما مات لا تزال على ذمته . سؤالي : قريبتي الزوجة الثانية من يرثها ؟ وفيم ينحصر إرثها؟ والذهب الذي أحضره الزوج المتوفى لها في العرس من حق مَنْ؟ ورثتها هي أم ورثة الزوج ؟ أم الاثنين معاً ؟ وكيف يقسم ؟ مع العلم أن له أبناء وبنات وأب وإخوة ، وهي لديها أم وأختان وأخ . ومؤخرها المتفق عليه في عقد الزواج ، هل يعطيه أهل الزوج لورثتها أم يسقط حقها وحقهم فيه؟ ولها منزل خاص بها استأجره الزوج ليكون بيتاً للزوجية وفرشه وأثثه ، لمن يعود الأثاث والفرش ؟ وله منزل ملك له تقيم فيه زوجته الأولى وأبناؤها ، هل لقريبتي أن ترث فيه وفيما ترك زوجها أم لا ؟ نرجو التوضيح المفصل والكامل الله يبارك فيكم .
الجواب





الحمد لله.
أولًا :
إذا مات الميت ورثه ورثته الأحياء ، ولابد أن نتحقق من حياة الوارث بعد موت المورِّث .
ففي الصورة المسؤول عنها : إذا تبين لنا أن أحد الزوجين تأخرت وفاته عن الآخر ولو بلحظة ، فإن المتأخر في الوفاة يرث الآخر ، ثم ينتقل الإرث إلى ورثته بعد ذلك .
أما إذا لم نعلم أي الزوجين مات أولاً ، فإن جمهور العلماء على أنه لا يثبت التوارث بينهما ، فلا يرث أحدهما الآخر ، لأن من شروط الإرث : أن نتحقق من حياة الوارث بعد موت المورِّث ، وهذا الشرط مفقود هنا .
فتقسم تركة الزوج على ورثته ، ولا ترث منه الزوجة شيئاً .
وتقسم تركة الزوجة على ورثتها ، ولا يرث منها الزوج شيئًا .
قال الشيخ ابن عثيمين رحمه الله في حكم ما لو مات جماعة يتوارثون في حادث عام ، قال :
"فمتى وقع ذلك فلا يخلو من خمسة أحوال :
الأولى : أن نعلم المتأخر منهم بعينه فيرث من المتقدم ولا عكس .
الثانية : أن نعلم أن موتهم وقع دفعة واحدة فلا توارث بينهم ، لأن من شروط الإرث حياة الوارث بعد موت مورثه حقيقةً أو حكماً ولم يوجد .
الثالثة : أن نجهل كيف وقع الموت هل كان مرتباً أو دفعة واحدة .
الرابعة : أن نعلم أن موتهم مرتب ، ولكن لا نعلم عين المتأخر .
الخامسة : أن نعلم المتأخر ثم ننساه .
وفي هذه الأحوال الثلاث [الأخيرة] لا توارث بينهم عند الأئمة الثلاثة [أبو حنيفة ومالك والشافعي] وهو اختيار الموفق ابن قدامة والمجد والشيخ تقي الدين ابن تيمية وشيخنا عبد الرحمن السعدي ، وشيخنا عبد العزيز بن باز ، وهو الصحيح ، لأن من شروط الإرث حياة الوارث بعد موت المورث حقيقةً أو حكماً ، ولا يحصل ذلك مع الجهل ، إلا أن الشافعية قالوا في الحال الأخيرة : يوقف الأمر حتى يذكروا أو يصطلحوا ، لأن التذكر غير ميؤوس منه" انتهى من "تسهيل الفرائض" (صـ 142، 143) .
وعلى هذا ؛ فعند تقسيم تركة الزوجة :
إن كان الزوج قد تأخرت وفاته عن الزوجة ، فإنه يرث منها ، وتقسم تركتها كما يلي :
الزوج له النصف ، والأم لها السدس ، والأخ والأختان لهم الباقي ، للذكر مثل حظ الأنثيين .
فإن كنا لا نعلم أن الزوج تأخرت وفاته عنها ، فتقسم تركتها على الأم والإخوة كما يلي :
للأم السدس ، والباقي للإخوة للذكر مثل حظ الأنثيين .
وأما تقسيم تركة الزوج :
فإن كانت الزوجة قد تأخرت وفاتها عنه ، فإنها ترثه ، وتقسم تركته كما يلي :
للزوجتين معاً الثمن ، وللأب السدس ، والأبناء لهم الباقي للذكر مثل حظ الأنثيين ، ولا شيء للإخوة .
فإن لم نعلم أن الزوجة ماتت بعده ، فإنها لا ترثه ، ويقسم ميراثه كالتقسيم السابق ، فللأب السدس، وللزوجة الأولى الثُّمن كاملاً ، وللأبناء الباقي للذكر مثل حظ الأنثيين .
ثانياً :
تركة قريبتك هي جميع ما تركته من مال تملكه ، فيدخل في ذلك : مهرها الذي أعطي لها من ذهب أو نقود ، وكذلك الهدايا التي أعطيت لها ؛ لأنها أصبحت ملكا لها .
وأما مؤخر صداقها : فهو دين على الزوج ، فلابد من أخذه من تركته ويضاف على تركتها ، ثم يقسم على ورثتها .
ويدخل في التركة : ديتها في حال كون الحادث تسبب فيه إنسان ، زوجها أو غيره ، وطالب ورثتها بالدية ، أو دفع التأمين لهم ديتها .
وأما أثاث البيت وفرشه ، فهو ملك للزوج ، إلا إذا كان جزءا من المهر كما هو العرف في بعض البلدان ، أو كان شيء منه أهداه الزوج لزوجته .
ثالثًا :
تركة الزوج : ما تركه من مال مملوك له ، ومنه : منزله الذي يملكه ، وهذه التركة توزع على جميع ورثته .
وينبغي أن يرجع في مسألة الميراث هذه إلى المحكمة الشرعية لتتولى حصر الورثة وحصر التركة ، ومعرفة ملابسات الوفاة ومن توفي من الزوجين أولا ، ولأن توارث الزوجين في مثل هذه الحالة فيه خلاف بين الأئمة فالذي يتولى حسم الخلاف بين الورثة هو القاضي .

If a couple died together in an accident, who inherits from whom?

Question

I have a relative who died along with her husband in an accident when they had only been married for about five months. This was her first marriage but he had another wife and sons and daughters, and when he died (the first wife) was still married to him.
My question is: who inherits from my relative who was the second wife? And what is to be included in her estate? Who is entitled to the gold that her deceased husband gave to her at her wedding? Does it go to her heirs or the heirs of the husband, or to both? How should it be divided? Please note that he has sons and daughters, and a father and siblings, and she has a mother, two sisters and a brother.
With regard to the delayed portion of the mahr that was agreed upon in the marriage contract, should the husband’s family give it to her heirs or is her and their right to it waived?
She had a separate house that the husband rented to be a marital home, and he furnished it and equipped it; to whom should the furniture and equipment go?
He also owned a house in which he and his first wife and children lived; can my relative inherit any part of it and of what her husband left behind, or not
?.

Praise be to Allah.
Firstly:
When a person dies he may be inherited from by his living heirs, so it is essential to establish whether the heir was still alive after the person died. In the case asked about here, if it becomes clear to us that one of the spouses died after the other, even by a short moment, then the one who died later inherits from the first one, then the inheritance passes to his or her heirs after that.
But if we do not know which of the two spouses died first, then the majority of scholars are of the view that it cannot be proven that they inherit from one another, so neither of them inherits from the other, because one of the conditions of inheritance is that we should establish that the heir was still alive after the death of the deceased, and this condition is not met in this case.
So the husband’s estate should be divided among his heirs, and his wife does not inherit anything from him.
And the wife’s estate should be divided among her heirs, and her husband does not inherit anything from her.
Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) said, concerning the ruling on a situation where a group of people who would inherit from one another died in an accident. He said: When that happens, one of the following five scenarios apply:
1.We know exactly who died last, so he inherits from those who died first, and not the other way round.
2.We know that they all died at the same time, so there is no inheritance among them, because one of the conditions of inheritance is that the heir should still be alive after the death of the deceased, de facto or de jure, but that is not the case here.
3.We do not know how they died; was it one after another or all at the same time?
4.We know that they died one after another, but we do not know exactly who died after whom.
5.We know who died after whom but then we forgot.
In the last three cases, they do not inherit from one another according to the three imams [Abu Haneefah, Maalik and ash-Shaafa‘i]; this is also the view favoured by al-Muwaffaq Ibn Qudaamah, al-Majd, Shaykh Taqiy ad-Deen Ibn Taymiyah and our shaykhs ‘Abd ar-Rahmaan as-Sa‘di and ‘Abd al-‘Azeez ibn Baaz. This is the correct opinion, because one of the conditions of inheritance is that the heir should still be alive after the death of the deceased, de facto or de jure, but this condition is not met when it is not known. However the Shaafa‘is said that in the last scenario these decisions should be delayed until they remember or agree, because remembering is not something impossible.

Based on that, when dividing the wife’s estate:
If the husband died after the wife, then he inherits from her, and her estate is to be divided as follows:
The husband gets one half, the mother gets one sixth, and the remainder goes to the brother and two sisters, with the male getting the share of two females.
If we do not know whether the husband died after she did, then her estate is to be divided among the mother and siblings as follows:
The mother gets one sixth, and the remainder goes to the brother and two sisters, with the male getting the share of two females.
With regard to this division of the husband’s estate:
If the wife died after he did, then she inherits from him and his estate is to be divided as follows:
The two wives together get one eighth, the father gets one sixth, and the children get the rest, with each male getting the share of two females. The siblings do not get anything.
If we do not know whether the wife died after him, then she does not inherit from him and his estate is to be divided as mentioned above. So the father gets one sixth, the first wife gets one eighth to herself, and the children get the rest, with each male getting the share of two females.
Secondly:
Your relative’s estate is everything that she left behind of wealth that she owned. That includes her mahr that was given to her, whether it was gold or cash, as well as gifts that were given to her, because they became her property.
With regard to the delayed portion of her mahr, this is a debt owed by the husband, so it must be taken from his estate and added to hers, then divided among her heirs.
Also included in her estate is the diyah if the accident was caused by an individual, whether it was her husband or anyone else and her heirs asked for the diyah or it was paid by the insurance.
With regard to the furniture and equipment in the house, they belong to the husband unless that was part of her mahr, as is customary in some countries, or any part of it was given as a gift by the husband to his wife.
Thirdly:
The husband’s estate is whatever he left behind of wealth that belonged to him. That includes the house that he owned. This estate is to be divided among all his heirs.
With regard to this issue of inheritance, reference should be made to the sharee‘ah court so as to find out and list all those who are entitled to inheritance and the estate, and to find out the circumstances of death and which of the spouses died first. Because there is a difference of scholarly opinion concerning inheritance between the spouses in such cases, the one who should handle any cases of disagreement among the heirs is the qaadi (judge).

Une de mes parentes a trouvé la mort avec son mari au cours d’un accident. Ils ne s’étaient mariés qu’environ cinq mois plus tôt. C’était le premier mariage pour ma parente. Quant à son mari, il avait une première épouse qui lui avait donné des fils et des filles et leur mariage était toujours en cours de validité lors de sa mort.
Ma question est la suivante: qui hérite de ma parente qui est la seconde épouse? Est-ce ses héritiers à elle ou les héritiers de son mari ou les deux à la fois? Comment répartir la succession en sachant que le mari a des fils , des filles, un père et des frères alors que son épouse a une mère , deux sœurs et un frère? Le reliquat de la dot qui lui est dû selon les clauses du contrat de mariage doit il être versé par la famille du mari aux héritiers de l’épouse ou elle perd le droit comme eux-mêmes de le percevoir? Elle logeait dans une maison spéciale louée , équipée et meublée par le mari pour en faire une résidence conjugale..Qui va hériter les meubles et tapis? Le mari possède une maison où réside sa première femme et ses enfants à elle. Ma parente aurait elle une part de l’héritage de cette maison et des autres biens légués par son mari

Louange à Allah.
Louanges à Allah Premièrement, quand une personne décède , ses héritiers vivant héritent de ses biens, à condition de constater que l’héritier a survécu à celui dont il doit hériter. Dans le cas en question, nous devons vérifier si l’un des époux a survécu à l’autre, ne serait-ce que pendant un instant. Si tel était le cas, celui qui a survécu hérite de l’autre. Puis sa part de l’héritage serait héritée par ses héritiers. Si nous ne savons pas lequel des deux a survécu à l’autre, la majorité des ulémas soutient qu’aucun des deux n’hérite de l’autre car la condition exigée pour hériter de quelqu’un est de lui survivre, ce qui n’est pas le cas ici.
La succession du mari sera répartie entre ses héritiers et l’épouse n’en recevra rien. De même,la succession de l’épouse sera répartie entre ses héritiers et le mari n’en recevra rien.
Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa miséricorde) dit à propos du cas dans lequel un groupe de personnes pouvant hériter les unes des autres trouve la mort dans un accident que cela se présente sous cinq formes:
La première est que noussavons précisément qui a survécu à qui. Dans ce cas, seul celui qui a survécu hérite de l’autre.
La deuxième est que nous savons qu’ils ont rendu l'âme simultanément. Dans ce cas, personne n’hérite de personne, la condition exigée pour hériter de quelqu’un étant de lui survivre réellement ou légalement, ce qui n’est pas établi ici.
La troisième est que nous ignoronss’ils sont morts simultanément ou successivement.
La quatrième est que nous savons qu’ils sont morts successivement mais nous ne pouvons pas établir l’ordre de succession.
La cinquième est que nous savions qui est mort après qui mais nous l’avons oublié.
Dans les trois dernières formes, aucune des victimes n’hérite des autres selon l’avis des trois imams que sont Abou Hanifah, Malick et Chaffii. C’est l’avis choisi par al-Mouwaffaq Ibn Qoudamah et par al-Madjd et par Cheikh Taquiddine, Ibn Taymiyyah, et par notre maître Abdodurrahmane Saadi et notre maître Abdoul Aziz ibn Baz. C’est l’avis justecar la condition exigée pour hériter de quelqu’un est de lui survivre réellement ou légalement, ce qui ne peut pas être retenu en cas d’ignorance. Cependant les Chafiites disent à propos de la dernière forme qu’on doit attendre qu’ils se souviennent ou s’arrangent car ce n’est pas désespéré.» Extrait de Tashiil a-faraidh,p. 142-143.
Cela étant, la succession de l’épouse doit être répartie comme suit:
- si le mari a survécu à son épouse, il hérite de ses biens. Aussi doit il en prendre la moitié tandis que la mère doit recevoir le sixième et le reliquat revient au frère et aux deux sœurs, le mâle recevant le double de la part de la femelle. Si nous ne savons pas que le mari a survécu à sa femme, on répartit sa succession à elle entre sa mère et ses frères et sœursde sorte que la mère reçoive le sixième et les frères et sœursle reste, le mâle recevant le double de la part de la femelle.
Quant à la répartition de la succession du mari, si sa femme lui a survécu, elle hérite de ses biens. Aussi les deux épousesprendront elles le huitième et le père le sixième et les enfants le reliquat, le mâle recevant le double de la part de la femelle car les frères ne recevront rien.
Si nous ne savons pas que l’épouse a survécu à son mari, elle ne l’hérite pas. La succession du mari sera répartie commedans le cas qui précède: le père prend le sixième, la première épouse prend le huitième entièrement et les enfants prendront le reliquat, le mâle recevant le double de la part de la femelle.
Deuxièmement, la succession de votre parenteconsiste dans tout ce qu’elle a légué en terme de fonds y compris la dot qui lui a été versée en or ou en argent ainsi que les cadeaux qui lui ont été offerts, puisque tout cela fait partie de sa propriété. Quant au reliquat de sa dot, il constitue une dette à payer par le mari. On doit en prélever le montant sur sa succession et l’ajouter à la succession de l’épouse avant de répartir le tout entre ses héritiers à elle.
La succession englobe le prix du sang (indemnités) au cas où l’accident serait dû à une erreur imputable à son mari ou à un autre, si les héritiers de la femme exigent un dédommagement ou si l’assurance le leur donnent.
Quant au mobilier et aux tapis de la maison, ils appartiennent au mari, à moins qu’ils ne fassent partie de la dot conformément à la coutume en cours dans certains pays ou qu’ils soient des cadeaux que le mari a offerts à sa femme.
Troisièmement, la succession du mari consiste dans tous ses biens y compris sa propre maison. Cette succession est à répartir entre tous ses héritiers.
Il convient de soumettre la répartition de cette succession à un tribunal religieux pour qu’il procède au recensement des héritiers et des biens constituant la succession et à l’établissement des circonstances des décès pour déterminer lequel des époux est décédé avant l’autre. En effet, l’héritage entre époux dans un tel cas peut faire l’objet d’une divergence de vues entre les imams. Seul un cadi peut trancher le contentieux qui pourraitopposer les héritiers.
