السؤال: هل يجوز التبرع بالأضحية لإخواننا فى الصومال ، عن طريق صك الأضحية - بنك مصر ؟ نظرا لما تمر به الصومال من ظروف المجاعة ، أم الأولى ذبح الأضحية فى بلدي .


الجواب:
الحمد لله
الأفضل للإنسان أن يذبح أضحيته بنفسه ؛ لما روى أنس بن مالك رضي الله عنه أن النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " ضَحَّى بِكَبْشَيْنِ أَمْلَحَيْنِ فَرَأَيْتُهُ وَاضِعًا قَدَمَهُ عَلَى صِفَاحِهِمَا يُسَمِّي وَيُكَبِّرُ فَذَبَحَهُمَا بِيَدِهِ " رواه البخاري5558- ومسلم 1966.
ويجوز أن يستنيب من يقوم مقامه في ذبح أضحيته ، ولو بلا عذر ؛ لما روى جابر أن " فَنَحَرَ ثَلَاثًا وَسِتِّينَ بِيَدِهِ، ثُمَّ أَعْطَى عَلِيًّا، فَنَحَرَ مَا غَبَرَ" رواه مسلم 1218.
قال الدكتور وهبة الزحيلي حفظه الله: " يستحب لمريد التضحية أن يذبح بنفسه إن قدر عليه؛ لأنه قربة ، ومباشرة القربة أفضل من تفويض إنسان آخر فيها، فإن لم يحسن الذبح فالأولى توليته مسلمًا يحسنه ، ويستحب في هذه الحالة أن يشهد الأضحية ؛ لقوله صلى الله عليه وسلم لفاطمة رضي الله عنها: يا فاطمة قومي إلى أضحيتك فاشهديها، وقد اتفقت المذاهب على هذا " انتهى من "الفقه الإسلامي وأدلته"4/ 273.مع التنبيه على ضعف الحديث هنا =

وأما التضحية خارج البلد ففيها خلاف بين أهل العلم .
قال الدكتور وهبة الزحيلي في المصدر السابق :4/ 282 : " أما نقلها إلى بلد آخر: فقال الحنفية: يكره نقلها كالزكاة من بلد إلى بلد ، إلا أن ينقلها إلى قرابته ، أو إلى قوم هم أحوج إليها من أهل بلده ، ولو نقل إلى غيرهم : أجزأه مع الكراهة.
وقال المالكية: ولا يجوز نقلها إلى مسافة قصر فأكثر، إلا أن يكون أهل ذلك الموضع أشد حاجة من أهل محل الوجوب، فيجب نقل الأكثر لهم، وتفرقة الأقل على أهله.
وقال الحنابلة والشافعية كالمالكية: يجوز نقلها لأقل من مسافة القصر، من البلد الذي فيه المال، ويحرم نقلها كالزكاة إلى مسافة القصر وتجزئه.." انتهى .
وقد اختار جمع من المعاصرين جواز التضحية خارج البلد لتعطى لمسلمين أشد حاجة وعوزا .
سئل الشيخ ابن جبرين رحمه الله ما نصه : " تهدي هيئة الإغاثة الإسلامية العالمية بـ المملكة العربية السعودية أطيب تحياتها لفضيلتكم وتسأل الله أن يديم نفع المسلمين بعلمكم وأن يجزيكم عن جهودكم خير الجزاء.
أشير إلى فتوى فضيلتكم "بجواز أخذ الهيئة أثمان الأضاحي من أصحابها وشراء أضاحٍ بها لذبحها وقت الذبح وتوزيعها على الفقراء المسلمين في بلاد أكثر فقرًا وأشد احتياجًا"، ولما كانت بعض الجمعيات السعودية تعمل منذ سنوات في هذا المجال استنادًا على هذه الفتوى ، بينما تواجه الهيئة حرجًا مع فقراء المسلمين في الخارج لتوقفها عن القيام بتقديم الأضاحي لهم في بلادهم ، لذا نأمل من فضيلتكم التكرم بإفادتي بنص الرأي الشرعي في هذا الشأن.
فأجاب : وصلنا خطابكم وفيه طلبكم الإفادة عن حكم إرسال قيمة الأضاحي لتذبح في الخارج وتقسم على فقراء المسلمين ، وحيث اطلعتم على فتوى لنا بجواز أخذ الهيئة أثمان الأضاحي من أصحابها وشراء أضاح بها لذبحها وقت الذبح وتوزيعها على الفقراء من المسلمين في بلادٍ أكثر فقرًا وأشد احتياجًا؛ فإننا قلنا بذلك نظرًا إلى أن الحكمة في ذبح الأضاحي إحياء السُنَّة والتوسعة على المسلمين في أيام الأعياد التي هي أيام فرحٍ واغتباط ، وحيث إن هذه المملكة يوجد بها أهل ثروة وكثرة خير، وأنهم قد أكثروا من الوصايا بذبح الأضاحي بحيث يذبح في المنزل الواحد العدد الكثير من الوصايا والقرابين ، ويقل وجود الفقراء الذين يحتاجون لأكلها في تلك الأيام ، فقد رأينا أن من الأنسب إرسال قيمتها إلى البلاد الفقيرة ليشترى بها ذبائح وتذبح في أيام العيد بأسماء أصحابها، وتقسَّم على فقراء المسلمين من أهل السُنَّة والجماعة ؛ فهو خيرٌ من أن تبقى مصبَّرةً يأكلها أهلها عدَّة أشهر، ومع ذلك إذا وجد فقراء في الداخل فإنهم أولى بأن تصرف لهم لسدِّ حاجتهم ، ولتحقيق أهليتهم ، فهذا ما نراه ، ولكم طلب الفتوى من غيرنا ، والله يتولانا جميعًا وصلى الله على محمد وآله وصحبه وسلم " انتهى من موقع الشيخ على الإنترنت .
وسئل رحمه الله : " هل يجوز إرسال لحوم الأضاحي إلى خارج المملكة إلى الناس المحتاجين والفقراء ، مثل البوسنة والهرسك والسودان ودول أفريقيا وجميع الدول الإسلامية ، للحاجة الضرورية إليها هناك؟ أفيدونا حفظكم الله.
فأجاب : يفضل ذبحها في البلد الذي أنت فيه ، لتحضر الذبح وتسمي عليها وتأكل وتهدي وتتصدق أثلاثًا، لكن إن كان البلد غنيًا ولا يوجد فيه فقراء ، وإذا أعطيت بعضهم خزنه أيامًا ولديهم اللحوم متوفرة طوال السنة ، جاز إرسالها لمن يحتاجها من البلاد الفقيرة الذين يعوزهم اللحم ، ولا يوجد عندهم إلا نادرًا، ولابد من تحقق ذبحه في أيام الذبح، وتحقق ذبح السن المجزئة السالمة من العيوب ، وتحقق أمانة من يتولى ذلك ، والله أعلم " انتهى من موقع الشيخ رحمه الله.
وجاء في "موقع المسلم" ، إشراف الدكتور ناصر العمر حفظه الله ، فتوى حول :
" نقل الأضحية خارج بلد المضحي " :
صورة المسألة : حكم نقل المضحي أضحيته لتذبح في بلد غير بلده ، سواء أ كان داخل دولته ، أم في دولة أخرى ؛ نظرًا لوجود مسلمين في تلك البلدان أشد حاجة إلى لحوم الأضاحي من المسلمين في بلده ؟
الحمد لله رب العالمين والصلاة والسلام على رسوله الكريم صلوات الله وسلامه عليه وعلى آله وصحبه أجمعين، وبعد :
اعلم أيها السائل الكريم أن من المصالح الكبرى التي عنيت بها الشريعة الإسلامية ، وكانت أحد مقاصدها العظمى ، تقديم المصالح، والعناية بذوي الحاجات والفقراء من المسلمين ، وإن من المصالح المحققة في هذا الباب جواز نقل الأضحية من بلد المضحي إلى بلد آخر ، لاسيما وليس في كتاب الله ولا في سنة رسوله _صلى الله عليه وسلم_ ما يمنع ذلك ويدفعه ، والأصل في ذلك الجواز ، فإذا كانت الزكاة وهي واجبة بالإجماع يجوز نقلها من بلد إلى بلد للمصلحة والحاجة ، فكيف بالأضحية المستحبة ؟!
وقد منع بعض أهل العلم من ذلك؛ مستدلاً بفوات إظهار الشعيرة ، وقد قال تعالى" وَالْبُدْنَ جَعَلْنَاهَا لَكُمْ مِنْ شَعَائِرِ اللَّهِ لَكُمْ فِيهَا خَيْر،ٌ فَاذْكُرُوا اسْمَ اللَّهِ عَلَيْهَا صَوَافَّ، فَإِذَا وَجَبَتْ جُنُوبُهَا فَكُلُوا مِنْهَا وَأَطْعِمُوا الْقَانِعَ وَالْمُعْتَرَّ، كَذَلِكَ سَخَّرْنَاهَا لَكُمْ لَعَلَّكُمْ تَشْكُرُون "الحج /36 .
وفي الاستدلال بهذه الآية نظر من وجهين :
الوجه الأول :
أن الناس لا يتفقون كلهم على ذبح ضحاياهم خارج بلادهم ، بل يبقى منهم من يضحي في بلده، فيبقى إظهار الشعيرة من هذا الوجه موجوداً .
الوجه الثاني :
على فرض أن الناس جميعًا يذبحون ضحاياهم خارج البلد ، فإن أصل إظهار الشعيرة باق غير منتف ، فهو يظهر ويقوى ظهوره في بلد آخر ، وإن ضعف ظهوره في بلد المضحي؛ وذلك للحاجة والمصلحة .
كما أن القصد من الأضاحي إظهار الشعيرة في كل بلد ، ونفع الفقراء من المسلمين ؛ يقول الله عز وجل " لَنْ يَنَالَ اللَّهَ لُحُومُهَا وَلا دِمَاؤُهَا وَلَكِنْ يَنَالُهُ التَّقْوَى مِنْكُمْ" الحج /37 .
وقد جاء في الصحيحين من طريق أبي عاصم ، عن يزيد بن أبي عبيد عن سلمة بن الأكوع رضي الله عنه قال : قال رسول الله صلى الله عليه وسلم "من ضحى منكم فلا يصبحن بعد ثالثة وفي بيته شيء، فلما كان العام المقبل قالوا: يا رسول الله نفعل كما فعلنا العام الماضي ؟ قال : كلوا وأطعموا وادخروا ، فإن ذلك العام كان بالناس جهد فأردت أن تعينوا فيها ".
فالشارع لما نظر إلى فاقة الناس ، حرَّم عليهم الادخار فوق ثلاثة أيام ، فلما زالت تلك العلة زال النهي .
وحينئذٍ لا نجد حرجًا من الفتوى بجواز نقل الأضحية من بلد إلى آخر، إذا دعت حاجة المسلمين لذلك ، فإن أعدادًا كبيرة من المسلمين يفترشون الأرض ويلتحفون السماء، ويعانون مسغبة ، وقد يموتون جوعًا ، والحاجة داعية إلى الوقوف معهم ، وإغاثتهم بالزكوات والصدقات ، ونقل الأضاحي إلى بلادهم ، فإنه لا يتعين في الأضحية مكان بلد المضحي ، وحين تفوت سنية الأكل من الأضحية فلا تفوت مصلحة إغاثة الفقراء والمساكين من المسلمين وسد حاجتهم ، والله أعلم ،وصلى الله وسلم على نبينا محمد وعلى آله وصحبه أجمعين " انتهى .

وعليه :
فلا حرج في إعطاء المال لمن يذبح لك أضحية في الصومال ، بشرط كونه ثقة مأمونا ، وذبحه لها في أيام الذبح التي هي أيام التشريق .

Slaughtering the udhiyah in another country


Is it permissible to donate the udhiyah to our brothers in Somalia by an udhiyah voucher through Egypt Bank, because of what Somalia is going through of famine? Or is it better to slaughter the udhiyah in my own country?

Praise be to Allah.
It is better for a person to slaughter his udhiyah himself, because of the report narrated by Anas ibn Maalik (may Allah be pleased with him), that the Prophet (blessings and peace of Allah be upon him) sacrificed two horned black and white rams, placing his foot on their sides; he said the name of Allaah and said takbeer, and slaughtered them with his own hand.
Narrated by al-Bukhaari (5558) and Muslim (1966).
It is permissible to appoint someone to slaughter the sacrifice on one’s behalf, even without a reason to do so, because of the report narrated by Jaabir according to which the Prophet (blessings and peace of Allah be upon him) slaughtered sixty-three [animals] with his own hand. Then he handed over to ‘Ali who slaughtered the rest. Narrated by Muslim (1218)
Dr. Wahbah az-Zuhayli (may Allah preserve him) said: It is mustahabb for the one who wants to offer a sacrifice to slaughter it himself if he is able to do so, because it is an act of worship and doing an act of worship oneself is better than delegating someone else to do it. But if a person is not skilled in slaughtering, it is better to delegate it to a Muslim who is good at it; in this case it is mustahabb to witness the sacrifice, because of the words of the Prophet (blessings and peace of Allah be upon him) to Faatimah (may Allah be pleased with her): O Faatimah, go to your udhiyah and witness it. And the madhhabs are unanimously agreed on that.
End quote from al-Fiqh al-Islami wa Adillatuhu (4/237)
With regard to offering the udhiyah outside of one’s country, there is a difference of opinion among the scholars concerning that.
Dr. Wahbah az-Zuhayli (op. cit., 4/282) said: As for transferring udhiyah to another country, the Hanafis said: It is makrooh to transfer it, like zakaah, from one country to another, unless he is transferring it to his relatives or to people who are in greater need of it than the people in his own country. If he transfers it to anyone else, it is valid although it is makrooh. The Maalikis said: it is not permissible to transfer it the distance at which shortening prayers becomes permissible or more, unless the people in that place are in greater need of it than the people in the place where it should be offered. In that case, he should transfer most of it to them and keep a smaller portion for his own family.
The Hanbalis and Shaafa‘is, like the Malikis, said: It is permissible to transfer it no more than the distance at which shortening prayers becomes permissible, from the country in which the udhiyah is due. But it is haraam to transfer it, as in the case of zakaah, the distance at which shortening prayers becomes permissible, although it is valid. End quote.
A number of contemporary scholars are of the view that it is permissible to offer the udhiyah outside one’s own country, so as to give to the Muslims who are in greater need and are poorer.
Shaykh Ibn Jibreen (may Allah have mercy on him) was asked: The Global Islamic Aid Council in Saudi Arabia, conveys its warmest greetings to you and asks Allah to continue to benefit the Muslims through your knowledge and to reward you immensely for your efforts.
I refer to your fatwa which says that it is permissible for the Council to accept the cost of udhiyah from its supporters and to buy udhiyahs with it to be slaughtered at the time of sacrifice and distributed to poor Muslims in countries that are poorer and in greater need. Some Saudi charities have been working in this field for several years on the basis of this fatwa, whereas the Council is in an embarrassing situation vis-à-vis the poor Muslims in other countries because it has stopped offering the udhiyah to them in their countries. Hence we hope that you will do us the honour of stating the shar‘i opinion on this matter.
He replied:
We have received your message with your request for information on the ruling on sending the value of the udhiyah to be slaughtered in other countries and distributed among poor Muslims, as you read in a fatwa of ours that it is permissible for the Council to take the price of the udhiyahs from its supporters and use it to buy the animals to be slaughtered at the time of sacrifice and distributed to the Muslims in a country that is poorer and in greater need. We said that on the basis that the wisdom behind offering a sacrifice is to revive the Sunnah and bring some relief to Muslims on the days of Eid which are days of joy and happiness, because in this country there are people who are wealthy and want to do good, and they had left instructions to slaughter udhiyah so that in one household a great number of udhiyahs are being offered, but there are few poor people who need to eat it during those days. So we thought that it was more appropriate to send the money to a poor country with which to buy the animals and slaughter them during the days of Eid in the name of the donors, and divide them among the poor Muslims of Ahl as-Sunnah wa’l-Jamaa‘ah. This is better than leaving the meat frozen to be eaten over a number of months. However, if there are poor people in one’s own country, then it is better to give it to them so as to meet their needs. This is what we think, but you may ask others for fatwas. May Allah bless us all and send blessings and peace upon Muhammad and his family and companions.

And he (may Allah have mercy on him) was asked: Is it permissible to send the meat of one’s sacrifice outside the Kingdom, to needy and poor people, such as those in Bosnia and Herzegovina, Sudan, African countries and other Muslim countries, because of great need there? Please advise us, may Allah protect you
He replied:
It is preferable to slaughter it in the country where you are, so that you may be present at the slaughter and say the name of Allah over it, and eat from it, give some as gifts and give some in charity, by thirds. But if it is a rich country and there are no poor people there, and if you give to some of them they will store it for several days and they have abundant meat throughout the year, then it is permissible to send it to those who need it in poor countries where meat is scarce and they only have it rarely. But it is essential to make sure that the sacrifice is done during the days of sacrifice, and that the animal is of the right age and free of defects, and that the person appointed to do that is trustworthy.

In the Almoslim.net website, supervised by Dr. Naasir al-‘Umar (may Allah preserve him), there is a fatwa about transferring the udhiyah outside the land where the sacrifice was offered.
The issue is: the ruling on the one who is offering the sacrifice transferring his udhiyah to be slaughtered in a place other than his own, whether that is in the same country or in another country, on the grounds that there are Muslims in that country who are in greater need of the udhiyah meat than the Muslims in his own country.
Praise be to Allah, the Lord of the Worlds, and blessings and peace be upon His Noble Messenger and upon his family and companions.
It should be noted that one of the major issues to which Islam pays attention, and one of its greater aims, is to promote what is in people’s interests and to take care of needy and poor Muslims. One of the important issues in this regard is the permissibility of transferring the udhiyah from the land of the one who is offering the sacrifice to another land, especially as there is nothing in the Book of Allah or the Sunnah of His Messenger (blessings and peace of Allah be upon him) to suggest that this is not allowed. The basic principle in that regard is that it is permissible. If it is permissible in the case of zakaah, which is obligatory according to consensus, to transfer it from one land to another land to serve a greater interest and meet a greater need, then how about the udhiyah, which is mustahabb?
Some scholars disallowed it, on the grounds that it means missing out on practising this ritual, and Allah says (interpretation of the meaning):
“And the Budn (cows, oxen, or camels driven to be offered as sacrifices by the pilgrims at the sanctuary of Makkah.) We have made for you as among the Symbols of Allah, therein you have much good. So mention the Name of Allah over them when they are drawn up in lines (for sacrifice). Then, when they are down on their sides (after slaughter), eat thereof, and feed the beggar who does not ask (men), and the beggar who asks (men). Thus have We made them subject to you that you may be grateful”
[al-Hajj 22:36].
But quoting this verse as evidence is a matter that is subject to further discussion, for two reasons:
1. Not everyone has their udhiyah offered outside their own countries; rather there are still some who offer the sacrifice in their own countries, so practising the ritual is still being done..
2. Even if we assume that all people are having their udhiyahs sacrificed outside their country, the basic principle of practising the ritual is still being carried out. It is being more strongly manifested in another country, even if it is less so in the country of the one who is offering the sacrifice, and that is done on the basis of need and serving an interest.
The aim of offering the sacrifice is to practise the ritual in every country and to benefit the poor Muslims. Allah, may He be exalted, says (interpretation of the meaning):
“It is neither their meat nor their blood that reaches Allah, but it is piety from you that reaches Him”
[al-Hajj 22:37].
In as-Saheehayn it is narrated via Abu ‘Aasim, from Yazeed ibn Abi ‘Ubayd that Salamah ibn al-Akwa‘ (may Allah be pleased with him) said: The Messenger of Allah (blessings and peace of Allah be upon him) said: “Whoever among you offers a sacrifice, nothing of it should be left in his house after the third day.” The following year, they said: O Messenger of Allaah, should we do what we did last year? He said: “No, that was a year when people were hard-pressed, and I wanted (the meat) to be distributed among them.”
When the Lawgiver looked at people’s poverty, they were forbidden to store the meat for more than three days, but when that reason no longer applied, the prohibition was lifted.
In that case we do not see anything wrong with the fatwa which permits transferring the udhiyah from one country to another, if the Muslims have a need for that. There are large numbers of Muslims who are sleeping under the stars (homeless) and are starving and may die of hunger, so there is an urgent need to help them and come to their aid with zakaah and charity, and to transfer the udhiyah to their countries. It is not essential for the udhiyah to be offered in the place where the one who is offering it is; if he misses out on the Sunnah of eating from his sacrifice he will not miss out on helping poor and needy Muslims. And Allah knows best. May Allah send blessings and peace upon our Prophet Muhammad and upon all his family and companions. End quote.

Based on that:
There is nothing wrong with giving money to someone to slaughter the udhiyah for you in Somalia, on condition that he is trustworthy and that he will slaughter it during the days of sacrifice which are the days of at-tashreeq.

Faire égorger des sacrifices hors de son pays


Est il permis de donner des animaux à sacrifier au profit de nos frères de la Somalie en utilisant la voie du chèque à sacrifice délivré par la Banque d'Egypte et compte tenu de la famine qui sévit dans ce pays, ou est il préférable d'égorger le sacrifice sur place?

Louanges à Allah
Il est préférable qu'on égorge soi-même son sacrifice, en vertu de ce qui a été rapporté d'après Anas selon lequel le Prophète (Bénédiction et salut soient sur lui) a sacrifié deux béliers blancs porteurs de tâches noires. Je l'ai vu placer son pied sur leurs nuques , prononcer le nom d'Allah et dire Allah akbar avant de les égorger de sa propre main.» (Rapporté par al-Bokhari,5558 et par Mouslim,1966).
Il est permis de se faire remplacer pour égorger l'animal à sa place , même en l'absence d'une excuse. En effet, Djaber a rapporté que le Prophète (Bénédiction et salut soient sur lui) a égorgé soixante trois bêtes de sa propre main. Puis il laissa Ali égorger le reste des bêtes.» (Rapporté par Mouslim,1218).
Dr Wahbah az-Zouhayli (Puisse Allah le protéger) dit: «Il est recommandé à celui qui veut sacrifier des bêtes de les égorger lui-même, s'il le peut, puisqu'il s'agit d'un acte entrepris pour se rapprocher d'Allah. Or il est préférable de faire un tel acte soi-même au lieu de s'y faire remplacer. Si on ne sait pas égorger, il vaut mieux le faire faire par un musulman capable de le faire correctement. Dans ce cas, il est recommandé au principal intéressé d'assister à l'acte conformément à la parole du prophète (Bénédiction et salut soient sur lui) adressée à Fatimah (P.A.a): «Ô Fatimah! Va assister à l'égorgement de ton sacrifice.» Ceci fait l'objet d'un consensus au sein des écoles juridiques musulmanes. Extrait de al-Fiqh al-islami wa adillatouh (4/273).
Quant au sacrifice fait hors son pays, il fait l'objet d'une divergence de vues au sein des ulémas. Dr Wahbah az-Zouhayli dit dans son ouvrage susmentionné (4/282): «Quant à son transfert (du sacrifice) d'un pays vers un autre, les hanafites soutiennent qu'il est réprouvé de transférer un sacrifice d'un pays vers un autre, à moins que cela ne profite à son village natal ou à des gens qui en éprouvent un plus grand besoin par rapport à ses compatriotes. Le transfert est jugé suffisant mais réprouvé.
Pour les Malikites, il n'est pas permis de faire ledit transfert sur une distance justifiant le raccourcissement de la prière (85km) ou plus loin, à moins qu'il ne vise à privilégier des gens qui en éprouvent un plus grand que celui des gens du lieu de provenance. Dans ce cas, il faut transférer la majeure partie de la zakat et distribuer le reste aux siens.
Les hanbalites et les chafiites emboitent le pas aux malikites mais soutiennent le transfert de la zakat du pays de collecte sur une distance inférieure à celle justifiant le raccourcissement de la prière. Toutefois, il est interdit de transférer un sacrifice vers une destination égale à ladite distance. Si on le fait, l'acte suffit. Un groupe de contemporains ont choisi la permission de transférer le sacrifice hors de son pays pour en faire profiter des musulmans qui en éprouvent le plus grand besoin.
Cheikh Ibn Djabrine (Puisse Allah lui accorder Sa miséricorde) a été interrogé en ces termes: «L'Organisation Islamique Internationale de Secours(OIIS) basée en Arabie Saoudite présente ses compliments à votre éminence et demande à Allah de permettre aux musulmans de profiter éternellement de votre savoir et de vous accorder la meilleure récompense pour vos efforts.
Je me réfère à votre fatwa autorisant la dite Organisation à percevoir les prix des sacrifice auprès des fidèles pour acheter des animaux à sacrifier au moment opportun et les distribuer aux musulmans démunis des pays les plus pauvres donc qui en éprouvent le plus grand besoin. Etant donné que certaines associations saoudiennes mènent des activités dans ce domaine depuis des années en se fondant sur ladite fatwa alors que l'Organisation est gênée dans ses rapports avec les musulmans pauvres de l'Etranger en raison de la cessation de sa distribution des sacrifices dans leurs pays. Voilà pourquoi j'espère que votre éminence daigne me fournir le texte religieux relatif à cette affaire.
Voici sa réponse: «Nous avons reçu votre message dans lequel vous nous demandez de vous expliquer le statut de l'envoi de la valeur des sacrifices pour qu'on les égorge à l'Etranger et les distribuer aux musulmans pauvres puisque vous aviez appris notre fatwa autorisant l'Organisation Islamique Internationale de Secours (OIIS) à percevoir les prix des sacrifices auprès des fidèles pour acheter des animaux à sacrifier au moment opportun et les distribuer aux musulmans infortunés des pays les plus pauvres donc qui en éprouvent le plus grand besoin.
Nous nous sommes certes exprimés comme nous l'avons fait en tenant compte de la sagesse qui sous tend l'égorgement des sacrifices, à savoir la revivification de la Sunna et la facilitation de la vie aux musulmans au cours des jours de fête qui sont des journée de joie et de réjouissance.
Nous avons encore tenu compte du fait que le Royaume d'Arabie Saoudite abrite des gens aisés très attirés par la bienfaisance qui recommandent souvent la multiplication des sacrifices au point qu'on trouve dans le même foyer de nombreuses recommandations portant sur des sacrifices et offrandes alors qu'il demeure rare de trouver des pauvres ayant besoin de les consommer pendant les jours de fête.
C'est pourquoi nous avons jugé plus approprié d'en envoyer la valeur à des pays pauvres afin qu'on y achète des animaux et les sacrifie pendant les jours de la Fête au nom des donneurs et les distribuer aux musulmans pauvres issus de la communauté des fidèles à la Sunna. C'est mieux que de les congeler pour permettre aux auteurs de sacrifices de consommer la viande durant plusieurs mois.
Si toutefois il y a des pauvres locaux, ils méritent plus que les autres qu'on leur fassent bénéficier des sacrifices de manière à couvrir leurs besoins et à les réhabiliter (socialement). Voilà ce que nous pensons. Vous pouvez solliciter une fatwa auprès d'autres. Puisse Allah veiller sur nous tous. Puisse-t-Il bénir et saluer Muhammad, sa famille et ses compagnons.» Extrait du site web du Cheikh.
Il a encore été interrogé (Puisse Allah lui accorder Sa miséricorde) en ces termes: «Est il permis d'envoyer la viande des sacrifices à l'extérieur du Royaume d'Arabie Saoudite pour en faire profiter des pauvres et des nécessiteux comme ceux de la Bosnie Herzégovine, du Soudan, des pays africains et de tous les pays islamiques vu les besoins ressentis dans ces zones? Dites nous ce qu'il en est. Puisse Allah vous protéger.»
Voici sa réponse : «Il est préférable d'égorger les animaux à sacrifier dans le pays où se trouve l'auteur du sacrifice afin que l'opération se passe en sa présence et qu'il puisse prononcer le nom d'Allah, manger de la viande en offrir une partie aux autres et faire aumône d'un autre tiers. Si toutefois le pays est tellement riche qu'on y trouve pas de pauvres et si les gens qui reçoivent de la viande en cadeaux les conservent pendant des jours alors qu'ils possédaient déjà de la viande suffisante pour leur consommation annuelle, si tel est le cas, il est permis d'envoyer de la viande à ceux qui en ont besoin dans les pays pauvres et n'en trouvent que rarement. Mais il faut alors s'assurer que les animaux soient égorgés pendant les jours prévus à cet effet et vérifier les normes d'âge, d' intégrité physique des bêtes et de l'honnêteté des personnes chargées d'exécuter l'opération. On trouve dans le Site du musulman supervisé par le Dr Nassir al-Omar (Puisse Allah les protéger) une fatwa sur l'envoi des sacrifices à un endroit autre que le lieu de résidence du sacrifiant
Voici comment la question est formulée: le statut de l'envoi d'un sacrifice par son auteur afin qu'on l'égorge ailleurs, soit à l'intérieur du territoire de son pays ou dans un autre pays compte tenu de la présence dans le pays de destination de musulmans qui éprouvent un plus grand besoin des cette viande comparés aux musulmans de son pays?
Louanges à Allah, Maitre des univers. Bénédiction et salut sur Son noble messager, sur sa famille et sur tous ses compagnons. Cela dit, sachez, ô cher auteur de la question, que figure parmi les intérêts majeurs que la Charia vise à réaliser comme l'un de ses plus grands objectifs, l'établissement d'un ordre de priorité pour bien s'occuper des musulmans nécessiteux et pauvres. Figure parmi les intérêts bien réels qui s'inscrivent dans ce chapitre la permission de transférer de la viande d'un pays vers un autre, étant donné l'absence dans le livre d'Allah et dans la Sunna de Son messager (Bénédiction et salut soient sur lui) d'une disposition s'y opposant et étant donné que la chose est en principe permise.
Si la zakat, considérée par consensus comme une obligation religieuse, peut être transférée d'un pays vers un autre compte tenu d'un intérêt et d'un besoin, que dire du sacrifice qui n'est que recommandé?! Cependant des ulémas l'interdisent en évoquant la perte du rituel dont Allah Très haut dit: «Nous vous avons désigné les chameaux (et les vaches) bien portants pour certains rites établis par Allah. Il y a en eux pour vous un bien. Prononcez donc sur eux le nom d'Allah, quand ils ont eu la patte attachée, (prêts à être immolés). Puis, lorsqu'ils gisent sur le flanc, mangez-en, et nourrissez-en le besogneux discret et le mendiant. Ainsi Nous vous les avons assujettis afin que vous soyez reconnaissants.» (Coran,22:36).Le fait de tirer un argument de ce verset est discutable pour deux considérations:
La première est que les gens ne sont pas tous d'accord sur l'envoi de leurs sacrifices pour qu'ils soient égorgés hors de leurs pays. Il y a toujours des gens qui font leurs sacrifices chez eux pour perpétuer le rituel sus-indiqué.
La deuxième est que , à supposer que tout le monde fasse faire le sacrifice hors de leur pays, l'essentiel du rituel demeure et se maintient tout en s'exportant remarquablement ailleurs, dût cela entraîner une diminution de l'observance du rite dans le pays du sacrifiant, diminution justifiée par des besoins et des intérêts. Il s'y ajoute que la finalité du sacrifice est de répandre l'observance du rite dans tous les pays et d'en faire profiter à tous les musulmans pauvre. Allah le Puissant et Majestueux dit: «Ni leurs chairs ni leurs sangs n'atteindront Allah, mais ce qui L'atteint de votre part c'est la piété» (Coran,22:37).
Il est rapporté dans les Deux Sahih d'après Abou Assim d'après Yazid ibn Abou Oubayd qui le tenait de Salamah ibn al-Akwah (P.A.a) selon lequel le Messager d'Allah (Bénédiction et salut soient sur lui) a dit : «Que celui d'entre vous qui fait un sacrifice n'en conserve pas la viande chez lui plus de trois jours.» L'année suivante les gens lui dirent : «Ô Messager d'Allah! Devons nous faire comme l'année passée?» Il dit: «Mangez en une partie et faites en manger et conservez en (une partie). L'année écoulée était marquée par une disette et j'ai voulu y favoriser l'entraide.»
Tenant compte des besoins des gens, le législateur leur a interdit la conservation de la viande au-delà de trois jours. Puis l'interdiction fut levée, sa cause ayant disparue. Dès lors, nous n'éprouvons aucune gêne quand nous émettons une fatwa autorisant le transfert de la viande d'un pays vers un autre pour répondre aux besoins des musulmans. Il est vrai qu'un immense nombre de ces derniers se couchent à même le sol et n'ont pour couverture que le ciel et ils se tordent de faim.
Le besoin se fait sentir de se tenir à leurs côtés, de les secourir grâce aux recettes de la zakat, aux aumônes et au transfert des sacrifices vers eux. En effet, il n'est pas dit que le sacrifice ne doit être fait qu'au pays de son auteur. Si ce dernier rate la Sunna qui veut qu'il mange de la viande de son sacrifice, il ne rate pas l'intérêt que représente le secours apporté à des musulmans pauvres pour couvrir leurs besoins. Allah le sait mieux. Puisse Allah bénir et saluer notre prophète, Muhammad, sa famille et ses compagnons.

Cela étant, il n' y aucun inconvénient à ce qu'on donne de l'argent à quelqu'un pour faire égorger son sacrifice en Somalie, à condition que le mandataire soit digne de confiance et qu'il égorge le sacrifice pendant les jours prévus à cet effet.
