Le jugement des sécrétions qui se dégagent de l’utérus

السؤال

أجد فجأة على ملابسي الداخلية إفرازات شفافة لا أحس بنزولها ، هل تجوز الصلاة بذلك ؟ وإذا كانت لا تجوز هل يجب إعادة الوضوء وتغيير الملابس ؟.
نص الجواب




الحمد لله
الكلام على هذه الإفرازات في مسألتين :
الأولى : هل هي طاهرة أو نجسة ؟
فمذهب أبي حنيفة وأحمد وإحدى الروايتين عن الشافعي –وصححها النووي- أنها طاهرة .
واختار هذا القول الشيخ ابن عثيمين ، رحم الله الجميع .
قال في الشرح الممتع :1/457:
"وإذا كانت –يعني هذه الإفرازات- من مسلك الذكر فهي طاهرة ، لأنها ليست من فضلات الطعام والشراب ، فليست بولاً ، والأصل عدم النجاسة حتى يقوم الدليل على ذلك ، ولأنه لا يلزمه إذا جامع أهله أن يغسل ذكره ، ولا ثيابه إذا تلوثت به ، ولو كانت نجسة للزم من ذلك أن ينجس المني ، لأنه يتلوث بها" اهـ .
وانظر : "المجموع" 1/406 ، "المغني" 2/88 .
وعلى هذا ، فلا يجب غسل الثياب أو تغييرها إذا أصابتها تلك الرطوبة .
المسألة الثانية : هل ينتقض الوضوء بخروج هذه الإفرازات أو لا ؟
فالذي ذهب إليه أكثر العلماء أنها تنقض الوضوء .
وهو الذي اختاره الشيخ ابن عثيمين ، حتى قال :
"الذي ينسب عني غير هذا القول غير صادق ، والظاهر أنه فهم من قولي إنه طاهر أنه لا ينقض الوضوء" اهـ.
مجموع فتاوى الشيخ ابن عثيمين :11/287 .
وقال أيضًا :11/285 :
"أما اعتقاد بعض النساء أنه لا ينتقض الوضوء فهذا لا أعلم له أصلا إلا قول ابن حزم" اهـ .
لكن . . إذا كانت هذه الرطوبة تنزل من المرأة باستمرار ، فإنها تتوضأ لكل صلاة بعد دخول وقتها ، ولا يضرها نزول هذه الرطوبة بعد ذلك ، ولو كانت في الصلاة .
قال الشيخ ابن باز رحمه الله :
"إذا كانت الرطوبة المذكورة مستمرة في غالب الأوقات فعلى كل واحدة ممن تجد هذه الرطوبة الوضوء لكل صلاة إذا دخل الوقت ، كالمستحاضة ، وكصاحب السلس في البول ، أما إذا كانت الرطوبة تعرض في بعض الأحيان –وليست مستمرة- فإن حكمها حكم البول متى وُجدت انتقضت الطهاة ولو في الصلاة" اهـ .

Ruling on the discharges that come out from the woman’s uterus


Question

A girl noticed some thin discharge on her underwear but she had not felt it come out. Is it permissible for her to pray with her underwear on which this discharge has gotten? If it is not permissible, then does she have to repeat her wudoo’ and change her underwear?.


Answer



Praise be to Allaah. The discussion on such discharges focuses on two issues:
1 – Is it taahir (pure) or naajis (impure)?
The view of Abu Haneefah and Ahmad, and one of the two views narrated from al-Shaafa’i – which al-Nawawi classed as correct – is that it is pure. This view was also favoured by Shaykh Ibn ‘Uthaymeen, who said in al-Sharh al-Mumti’ (1/392):
If these discharges come as the result of intimacy then they are pure, because they are not the waste products of eating and drinking, thus they are not urine. The basic principle is that there is no impurity unless there is evidence that something is impure. Because a man is not obliged to wash his penis if he has intercourse with his wife nor to wash his garment if anything gets onto it; if it were impure then the maniy (sememn – which is pure) would become impure (through contamination with these discharges).

Based on this, she does not have to wash her underwear or change them if these discharges get on them.
2 – Is wudoo’ invalidated as a result of these discharges or not?
The view of most of the scholars is that this does invalidate wudoo’.
This is the view favoured by Shaykh Ibn ‘Uthaymeen, who said:
Anyone who attributes to me the view that this does not invalidate wudoo’ is not correct. It seems that he understood from my words that it is pure and does not invalidate wudoo’.

And he also said (11/285):
With regard to the belief of some women, that (these discharges) do not invalidate wudoo’, I do not know of any basis for that except the view of Ibn Hazm.
But, if a woman experiences this wetness constantly, then she should do wudoo’ for every prayer after the time for the prayer begins, and it will not matter if this wetness if discharged after that, even if that happens whilst she is praying.
Shaykh Ibn Baaz (may Allaah have mercy on him) said:
If the wetness described happens continually, most of the time, then every woman who experiences that must do wudoo’ for every prayer when the time begins. This is similar to the case of a woman who suffers from istihaadah (ongoing non-menstrual vaginal bleeding) or one who suffers from urinary incontinence.
But if this wetness only happens sometimes, and is not ongoing, then it comes under the same rulings as urine – when it happens it invalidates purity, even during the prayer.

Il m’arrive soudainement de découvrir sur mes sous vêtements des traces de souillure limpides qui se dégagent à mon insu. Est-il permis de prier en dépit de leur présence? Si cela n’est pas permis, faudrait-il refaire les ablutions et changer les vêtements?

Ces sécrétions sont abordées dans le cadre de deux questions. La première est de savoir si elles sont propres ou impropres (du point de vue religieux). Selon la doctrine d’Abou Hanfia, de celle d’Ahmad, d’après l’une des deux versions reçues de lui, et celle de Chafii jugée authentique par an-Nawawi, elles sont propres. Cet avis a étéchoisi par Cheikh Ibn Outhaymine (Puisse Allah accorder Sa miséricorde àtous).
Dans son ach-char-charh al-moumt’i (1/457), ce dernier écrit: Les sécrétions qui se dégagent du pénis sont propres car elles ne constituent pas des résidus alimentaires et ne relèvent pas de l’urine. Dès lors , elles ne peuvent être jugées impropres que sur la base d’un argument. Il s’y ajoute que l’homme n’est pas tenu de se laver le sexe après avoir eu un rapport intime avec sa femme, ni de laver ses vêtements en cas de souillure. Si lesdites sécrétions étaient impropres, le sperme leur serait assimilécar il provoque une souillure. Voir encore al- Madjmou (1/406); al-Moughni(2/88). Cela étant, on n’est pas tenu de se laver les vêtements touchés ni de les changer. La seconde question est de savoir si l’apparition des sécrétions en question entraine la rupture des ablutions? Pour la majoritédes ulémas, elles les rompent. C’est l’avis choisi par Cheikh Ibn Outhaymine qui va jusqu’a dire: celui qui m’a attribuéun autre avis ne dit pas la vérité. Peut-être a -t-il compris de mon affirmation de leur propretéqu’elles ne rompent pas les ablutions. Voir Madjmou fatawa cheikh Ibn Outhaymine (11/287). Il dit encore: Quant àla croyance de certains femmes selon laquelle elles n’entraient pas la rupture des ablutions , j’en connais pas le fondement en dehors d’un avis d’Ibn Hazem.
Si toutefois , une mouillure est constamment présente chez une femme, elle doit faire ses ablutions dès l’entrée de l’heure de chaque prière. La continuation de la mouillure ne représente aucun inconvénient, même si cela était constatéau cours de la prière.
Cheikh Ibn Baz (Puisse Allah lui accorder Sa miséricorde) a dit: Si ladite mouillure persiste la plus part du temps, toute femme qui l’éprouve doit faire ses ablutions pour chaque prière dès l’entrée de son heure .C’est le cas notamment de celle confrontée àla perturbation de ses règles et de celui qui souffre d’énurésie. Si la mouillure apparait périodiquement sans persister , elle est assimilable àl’urine. Aussi rompt-elle les ablutions dès son apparition, fut-ce au cours de la prière.
